Mediation Facilities & Procedure
In terms of mediation facilities the types of cases which can be brought for mediation, are varied and wide ranging. The Institute for Conflict Management, LLC (ICM) has its own set of rules for mediation proceedings, entitled, ICM Mediation Guidelines & Procedures. An agreement providing for mediation before ICM shall mean the acknowledgment of the parties to accept the procedures and provisions of these Rules and to be bound by them. Alternatively, parties may also decide in a written agreement to follow other rules and procedures, as they consider appropriate. A non-refundable administrative fee is payable to ICM, upon submitting a submittal for mediation.  Parties will be provided mediator biographies from which they choose their preferred neutral.

Should parties be unable or unwilling to choose a neutral, the Director(s) of ICM will choose an appropriate mediator on their behalf.  Parties in a dispute may submit a written brief including therein a presentation of the facts of the dispute and their views together with supporting documents. ICM can also provide the venue and other services to manage and supervise the mediation proceedings.  ICM’s goal is provide a premier resolution service.  Should the parties prefer a service not listed on this site or within the ICM Mediation Guidelines & Procedures, special requests can be made.

Arbitration Facilities & Procedure
In terms of the administration of arbitration, ICM renders consultancy services and assists in ensuring a smooth conduct of arbitration proceedings. When disputes arise, ICM offers extensive administrative assistance to the parties acting as a channel of communication between them. It also acts as an appointing authority, when parties fail to agree on a choice of arbitrator. ICM maintains and provides parties with lists of independent and qualified international and local arbitrators and experts. As an administrator, ICM has its own modern set of arbitration rules; ICM Arbitration Rules & Procedures.  Under these procedural rules, which are based upon the highly regarded and widely used American Arbitration Association, ICM administers regional and international commercial arbitration.An agreement providing for arbitration before ICM and ICM shall mean the acknowledgment by the parties to accept the procedures and provisions of these rules and to be bound by them. However, like mediation, parties may decide in writing, to follow other procedural rules they consider appropriate. ICM’s Arbitration Rules & Procedures provide an easy and comprehensive procedure for parties to adopt.

Parties desiring arbitration are required to submit an application for arbitration along with all supporting documents to ICM. Due to the time saving aspect of the Rules, once an application for arbitration is submitted to ICM, the defendant is required within 30 days from the date of receipt to respond. Parties will be provided arbitrator biographies from which they choose their preferred neutral.  Should parties be unable or unwilling to choose a neutral, the Director(s) of ICM will choose an appropriate arbitrator or arbitrators on their behalf,  and confirms the appointment of the arbitrators as well as the chairman (for international cases) selected by the parties. Alternatively, ICM’s Director(s) may appoint a chairman if parties fail to agree on one, within 21 days from being presented with the application and a summary of the dispute. The award is issued within 30 days from the final date the arbitration proceedings or panel, unless a longer period is stipulated and agreed between the parties.

Additional Information

ICM responds to enquiries regarding any arbitral matters relating thereto by providing consultation on a professional basis. ICM also promotes mediation and arbitration, as alternatives to litigation for the settlement of commercial disputes, by organizing and hosting a series of informative seminars, symposians, conferences and workshops.

ICM extends its services and facilities to all parties wishing to arbitrate or mediate under the ICM Rules. This assistance includes providing parties with lists of highly skilled mediators, arbitrators and experts from different trades and businesses and offering fully equipped hearing rooms to conduct proceedings at reasonable rates.
