Neutral Services Fee Schedule

Mediation, Arbitration, & Conciliation

Filing Fees:A non-refundable filing fee of $200.00 per party must be paid as soon as a hearing date is scheduled. Filing fees cover costs associated with setting up the case, preparing the documents, and preparing for the hearing.

Panelists Fees for Mediation/Arbitration/Conciliation:Fees will be charged hourly, or by the half-day or full-day rate. Please see each panelists’ biography for his/her individual rates.

Travel:
There is no charge for panelists traveling within 20 miles of their office. The fee for travel time outside a 20-mile radius is 50% of a panelist’s regular hourly fee.

Payment Policy:
Parties must pay a deposit of the full amount of fees based on the estimated number of hours multiplied by the applicable hourly or half-day or full day rate. This deposit is due no later than two weeks prior to the mediation/arbitration/conciliation hearing, in order to reserve the date. In the event that the parties require multiple sessions, an additional fee deposit will be required to be paid before the start of each new session. Any additional fees not covered by the estimated fee following the final mediation session must be paid in full by each respective party within ten (10) business days thereafter.

Hours Charged:Fees are charged for preparation (review of briefs or documents, records, research) and the mediation or arbitration or conciliation proceeding. Payment is due upon receipt of invoices.

Cancellation, Continuance, Refund Policy:We recognize that an unexpected event may occur that requires a hearing be continued. We trust that you will understand that your mediation/arbitration/conciliation reservation keeps your time slot exclusively for you. If a hearing session is continued or cancelled within ten (10) business days of the reserved date, the full fees are non-refundable. If a hearing session is cancelled prior to 10 business days before the hearing, all fees will be refunded within ten (10) business days - EXCEPT the non-refundable filing fee of $200 per party.

Suspension of Proceedings for Non-Payment:
ICM reserves the right to suspend progress of the proceedings should any of the required fees remain unpaid by the required dates set forth in this schedule. Any of the fees herein may be paid by any party to ensure that the proceedings go forward without interruption. Such fees should then be apportioned and paid in accordance with the parties’ agreement reached in mediation, or may become part of an arbitrator’s award, should the mediation be unsuccessful and the matter go to arbitration.
